Terms of Service

“Feather Designs”, “we”, “us”, and “our” refer to the Feather Designs creative studio, its operators, contractors, agents, and affiliates. “You”, “your”, “Buyer”, and “Customer” refer to the individual or entity placing an order, accessing the website, or otherwise interacting with our services. “Product”, “Service”, and “Deliverable” refer to any digital good, design asset, file, template, source file, mock-up, branding kit, web asset, custom project, in-game item, gamepass, license, consultation, or any other item offered by Feather Designs in any currency, including United States Dollars (USD) and Roblox virtual currency (Robux). “Site” refers to all websites, domains, sub-domains, applications, Discord servers, and storefronts operated by Feather Designs.

These Terms of Service form a legally binding agreement between you and Feather Designs. You must affirmatively accept these Terms by ticking the acceptance checkbox during checkout before any payment is processed or any order is placed, regardless of whether the payment is made in USD via Stripe, in Robux via a Roblox gamepass, in any future supported currency, or via any other channel (including Discord, direct message, invoice, or third-party marketplace). Placing an order, transferring Robux, completing a Stripe checkout session, or otherwise paying any amount to Feather Designs constitutes additional, independent acceptance of these Terms in their entirety. If you do not agree to any part of these Terms, you must not place an order, must not transfer any payment, and must immediately stop using the Site.

We may revise these Terms at any time, at our sole discretion, without prior notice. The version of the Terms in force at the moment your order is placed governs that order, and the most current version posted on the Site governs all ongoing use of the Site and any future orders. Your continued use of the Site or placement of any new order after changes are posted constitutes acceptance of the revised Terms.

You represent and warrant that you are at least the age of majority in your jurisdiction (or, if you are a minor, that you have the verifiable consent of your parent or legal guardian who agrees to be bound by these Terms on your behalf), that you have full legal capacity and authority to enter into this agreement, and that all information you provide (including but not limited to your Discord username, email, Roblox username, billing details, and contact information) is true, accurate, current, and complete. We are not obliged to verify your age or identity and assume no liability for any misrepresentation by you.

All orders are subject to acceptance by Feather Designs at our sole discretion. We reserve the absolute right to refuse, cancel, suspend, or terminate any order at any time, for any reason or for no reason, including (without limitation) suspected fraud, abuse, chargeback risk, violation of these Terms, violation of the Roblox Terms of Use, capacity constraints, pricing or product errors, or any other reason we deem appropriate. Where an order is refused before payment is captured, no charge will occur. Where payment has already been captured and we elect to cancel, our maximum liability is limited as set out in Sections 7 and 12 below.

USD payments. USD orders are processed by Stripe, Inc. and are subject to Stripe’s own terms and privacy policies. Feather Designs does not store full card numbers. Any chargeback, reversal, or dispute initiated against a Stripe transaction constitutes a material breach of these Terms and authorises us to (i) immediately revoke any license granted, (ii) disable access to any delivered files or assets, (iii) report the dispute to Stripe and any relevant fraud network, and (iv) recover all reasonable costs, including dispute fees, from you.

Robux payments. Robux orders are completed by purchasing a designated Roblox gamepass on the Roblox platform. Robux are a virtual currency operated by Roblox Corporation; they have no monetary value, are not exchangeable for real currency by us, and are non-transferable and non-refundable once spent. You acknowledge that the Roblox platform, gamepass system, Robux taxation, currency conversion rates, and Roblox payouts are controlled entirely by Roblox Corporation and are outside our control. Feather Designs is not responsible for any Roblox-side fees, exchange shortfalls, gamepass delivery failures, account actions, terminations, rollbacks, or platform downtime. You represent that you own the Roblox account used and have the right to spend the Robux transferred.

All prices are quoted exclusive of any applicable taxes, duties, or third-party fees unless expressly stated otherwise. You are solely responsible for any taxes, levies, or charges imposed by your jurisdiction in connection with your purchase. Pricing, product availability, and product descriptions may change without notice. In the event of an obvious pricing error, we may cancel the affected order and refund only the amount actually charged in USD; we are not obliged to honour pricing errors in either currency.

ALL SALES ARE FINAL. ALL PAYMENTS — WHETHER IN USD, ROBUX, OR ANY OTHER CURRENCY — ARE STRICTLY NON-REFUNDABLE, NON-RETURNABLE, NON-EXCHANGEABLE, AND NON-CREDITABLE, TO THE MAXIMUM EXTENT PERMITTED BY LAW. By ticking the acceptance checkbox at checkout and by submitting payment, you expressly waive, to the fullest extent permitted by applicable law, any statutory cooling-off period, right of withdrawal, distance-selling refund right, or similar consumer right that would otherwise apply to digital content delivered immediately or made available on demand. You acknowledge that our Products are digital, custom-prepared, instantly accessible, and cannot be “returned” in any meaningful sense once delivered or made available.

Without limiting the foregoing, we do not provide refunds, credits, or replacements for any reason, including but not limited to: (a) change of mind; (b) failure to read product descriptions; (c) incompatibility with your software, hardware, account, server, game, or workflow; (d) you not knowing how to use the file; (e) dissatisfaction with style, colour, fit, or aesthetic; (f) accounts you provided being banned, deleted, or suspended; (g) Robux exchange-rate fluctuations or Roblox-side fees; (h) duplicate or accidental purchases; (i) a third-party platform (Roblox, Discord, Stripe, your bank, etc.) failing, removing, or restricting access; (j) you losing the delivered file; or (k) the project being cancelled by you after work has begun.

Where a refund is mandated by non-waivable applicable law, our total refund liability is strictly limited to the amount actually paid by you in USD for the specific transaction at issue. Robux payments are never refundable in cash; any remedy in respect of a Robux transaction is limited, at our sole discretion, to a replacement gamepass purchase credit of equal Robux face value, or a re-delivery of the original Deliverable.

Feather Designs reserves the absolute, unconditional, and unilateral right, at our sole discretion, to refuse, withhold, delay, suspend, revoke, recall, or terminate the delivery of any Product or Service — in whole or in part, before, during, or after payment — without any obligation to issue a refund, credit, or replacement, where we determine in good faith that any of the following has occurred or is reasonably likely to occur:

• Breach or attempted breach of these Terms by you;
• Violation of the Roblox Terms of Use, Roblox Community Standards, Discord Community Guidelines, Stripe Services Agreement, or any applicable law, regulation, or third-party terms;
• Fraudulent, abusive, harassing, threatening, defamatory, hateful, or discriminatory behaviour towards Feather Designs staff, contractors, customers, or third parties;
• Chargebacks, payment reversals, disputes, fraud signals, or use of stolen or unauthorised payment methods;
• Reverse engineering, scraping, reselling, redistributing, relicensing, sublicensing, or attempting to extract source files beyond the license granted;
• Use of our work to facilitate illegal activity, scams, impersonation, malware, exploitation, hate speech, sexual content involving minors, or any content prohibited by Roblox or applicable law;
• Provision of false, incomplete, or misleading information at checkout (including a fake or unreachable Discord username);
• Public misrepresentation of Feather Designs, defamation, or attempts to damage our reputation;
• Any conduct we reasonably consider to be incompatible with a professional working relationship.

In each of these cases, you acknowledge and agree that any payment already made (in USD, Robux, or any other currency) is forfeited as liquidated damages reflecting the difficulty of quantifying the harm caused, and you waive any claim to a refund, return, replacement, credit, or compensation. Where we determine that any of the above has occurred after delivery, we may revoke any license granted, demand the destruction of all copies of the Deliverable, and pursue any other remedy available at law or equity.

Delivery times are estimates only and are not guarantees. We will use reasonable efforts to deliver Products within any communicated timeframe but accept no liability for delay arising from any cause, including third-party platform outages, force majeure, or your failure to respond to communications. Delivery is effected when we transmit, link, post, or otherwise make the Deliverable available to you (typically via the Discord username you provided at checkout). It is your sole responsibility to monitor that account, accept friend requests or direct messages, download and back up the Deliverable promptly, and verify that you have received the correct file.

Failure on your part to be reachable, to respond to delivery messages within fourteen (14) days, or to download a Deliverable within thirty (30) days of being notified that it is available, shall constitute completed delivery. We are under no obligation to re-deliver lost files thereafter and any such re-delivery (if offered at all) may be subject to an additional fee at our sole discretion.

Unless an explicit, signed, written agreement provides otherwise, all intellectual property rights — including copyright, design rights, source files, working files, and underlying methods — in and to any Deliverable remain the exclusive property of Feather Designs. Upon successful payment in full and your continuing compliance with these Terms, Feather Designs grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the final delivered output for the specific purpose communicated at the time of order, on the platform for which it was commissioned (e.g., a single Roblox game, a single brand). Any other use — including resale, redistribution, mass production, relicensing, NFT minting, AI training, or use in a manner that competes with Feather Designs — is strictly prohibited and constitutes a material breach.

We retain the perpetual right to display, reproduce, and reference any Deliverable in our portfolio, marketing, social media, and case studies, with or without attribution to you, unless you obtain a written confidentiality agreement signed by us.

You shall not, and shall not permit any third party to: (a) use any Deliverable in any unlawful or harmful manner; (b) infringe any third-party right; (c) misrepresent any Deliverable as your own original creation in a manner that competes with us; (d) attempt to circumvent or disable any security feature of the Site; (e) harass any Feather Designs personnel or other customers; or (f) engage in any conduct that could reasonably bring Feather Designs into disrepute. Breach of this Section authorises immediate termination of all licenses, withholding of any undelivered Products, and forfeiture of any sums paid.

The Site and our delivery flow rely on third-party platforms, including Roblox Corporation, Discord, Inc., and Stripe, Inc. Feather Designs is independent from, and not affiliated with, sponsored by, or endorsed by, any of these companies. We are not responsible or liable for any act, omission, outage, account action, fee, currency-conversion shortfall, exchange-rate change, or policy change of any third-party platform. Your use of those platforms is governed by their respective terms.

THE SITE, ALL PRODUCTS, AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. We do not warrant that any Deliverable will meet your subjective expectations, achieve any commercial result, generate any revenue, attract any audience, comply with the rules of any specific third-party platform indefinitely, or remain compatible with any future version of any software, game engine, or platform.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FEATHER DESIGNS, ITS OPERATORS, OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, ROBUX, ROBLOX EARNINGS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SITE, ANY PRODUCT, OR ANY SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability for all claims arising out of or relating to these Terms, the Site, or any Product or Service, regardless of cause of action and whether in contract, tort, statute, or otherwise, shall not exceed the lesser of (i) the total amount actually paid by you to Feather Designs in USD for the specific order giving rise to the claim, or (ii) twenty United States Dollars (USD $20). For Robux-only transactions, our maximum aggregate liability shall not exceed the USD-equivalent value of five hundred (500) Robux at Roblox’s then-current Developer Exchange rate, or USD $5, whichever is lower.

You agree to defend, indemnify, and hold harmless Feather Designs and its operators, owners, employees, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms; (b) your misuse of any Deliverable; (c) your violation of any applicable law or third-party right; or (d) any content, instruction, or material you provide to us.

We may suspend or terminate your access to the Site, any account, and any pending order at any time, with or without notice, with or without cause, and without any liability to you. Upon termination for breach, all licenses granted hereunder immediately terminate, and you must destroy all copies of any Deliverable in your possession or control. Sections concerning payment, refunds, license, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

These Terms are governed by the laws of the jurisdiction in which Feather Designs is operated, without regard to conflict-of-laws principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Product or Service shall be resolved exclusively in the competent courts of that jurisdiction, and you irrevocably consent to the personal jurisdiction and venue of those courts. To the maximum extent permitted by law, you waive any right to a jury trial and to participate in any class action or class-wide arbitration.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. These Terms, together with any policy or notice referenced herein, constitute the entire agreement between you and Feather Designs concerning the subject matter and supersede all prior or contemporaneous understandings.
